1. Acceptance of Terms

By accessing or using the Feathers AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Feathers AI is a commercial roofing estimation platform that provides material takeoff calculations, project management tools, and related services for low-slope roofing professionals.

3. User Accounts

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Share your account credentials with unauthorized parties
  • Use automated tools to scrape or extract data from the Service

5. Estimates and Calculations

The Service provides material estimates for informational purposes. While we strive for accuracy, estimates are based on the information provided and standard industry practices. Feathers AI does not guarantee the accuracy, completeness, or suitability of any estimate for a specific project. Users are responsible for verifying all estimates before making purchasing or construction decisions.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEATHERS AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL FEATHERS AI'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

This limitation of liability is particularly important given the nature of construction technology: material estimates inform purchasing decisions, and Feathers AI cannot be held responsible for construction outcomes, material shortages, or project delays based on estimates generated by the Service.

7. Intellectual Property

All content, features, and functionality of the Service are owned by Feathers AI and are protected by copyright, trademark, and other intellectual property laws. Your use of the Service does not grant you ownership of any content or intellectual property.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Subscription and Payment

Certain features of the Service require a paid subscription. Payment terms, pricing, and billing cycles are presented at the time of purchase. All fees are non-refundable except as required by law or as expressly stated in these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the Service and require re-acceptance before you can continue using the platform. Your continued use of the Service after accepting updated Terms constitutes your agreement to the changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
